Granny sues Rockstar and Take-Two for false advertising
July 27th, 2005 (1:52pm) - An 85 year old grandma upset that she bought Grand Theft Auto: San Andreas for her 14-year-old grandson without knowing it contained hidden, sexually explicit scene has sued Rockstar Games and Take-Two on behalf of consumers nationwide.
Florence Cohen, of New York, said in the lawsuit filed in the U.S. District Court of Manhattan that Rockstar Games and its parent company, Take-Two, sold the game under false, misleading and deceptive practices. She seeks unspecified damages on behalf of herself and all consumers nationwide, saying the company should give up its profts from the game for what amounted to false advertising, consumer deception, and unfair business practices. Cohen said in the suit that she bought the game in late 2004 for her grandson when it was rated "M," for players 17 and older. According to the suit she directed that the game be taken away from her grandson, which had supposedly been done. Laurence D. Paskowitz, the lawyer who filed the lawsuit on behalf of Cohen, said no parent would knowingly buy an adult-only video game for their children. "They should really make sure this doesnt happen again," he said. "The least this company can do is offer refunds." This comes as another burden for Take-Two, as the FTC had announced its own investigation into the matter of any possibility of Take-Two falsely advertising their product, as well as having the product pulled from major national chain stores across the country.
